Types of PFAs in Pennsylvania

There are three types of PFAs, depending on the situation:

– Ex parte temporary PFA

– Emergency order

– Final PFA

Procedure for PFAs in Pennsylvania

To obtain a Protection From Abuse Order from your spouse, you must first file a petition with the Court of Common Pleas and appear before a judge. This will taken place during regular business hours and if approved by the judge, will last until the court hearing with in 10 days.

 

Emergency orders can also be filed outside of normal business hours by contacting your local police department. This option should be exercised if you believe that you or your children are in immediate danger. In that scenario, you must go to the courthouse on the next business day to file an ex parte temporary PFA if you would like to extend the order.

 

For either case, a court hearing will take place and the judge will decide if a Final PFA is necessary, which can last up to three years.
